court rules musk's 2018 tweet protected speech in labor dispute

Elon Musk has won a significant legal victory in relation to a tweet he posted in 2018 that was considered a threat to employee stock options during a labor dispute at Tesla.

A federal appeals court has ruled that the National Labor Relations Board (NLRB) was wrong in ordering Musk to delete the tweet, which he made while there were union organizing efforts taking place at a Tesla facility in Fremont, California.

The tweet in question stated that Tesla employees had the option to vote for unionization but questioned the value of union dues compared to the benefits of stock options.

Initially, the NLRB deemed the tweet to be an illegal threat, leading to a series of appeals.

Ultimately, the 5th US Circuit Court of Appeals determined that Musk's comments are protected speech under the Constitution, and the NLRB must review its order to reinstate a terminated employee, as there is a lack of evidence of anti-union bias.
