Pinki Anand, a senior advocate at the Supreme Court of India, has expressed the need for a more balanced approach to retrospective taxation in the online gaming sector.
During her speech at the Skoch Summit on 'New Dimension in Inclusive Growth,' she raised concerns about the fairness and long-term consequences of current Goods and Services Tax (GST) notices.
These notices impose tax amounts that exceed what companies can realistically generate. Anand stressed the importance of maintaining investor confidence and promoting business growth in India.
She argued that the existing taxation model, which taxes the full face value, is not sustainable. Anand also highlighted that online gaming taxes are typically based on Gross Gaming Revenue (GGR) globally.
She suggested that adopting similar international norms could create a more equitable and realistic taxation framework. Anand acknowledged the complexities of retrospective taxation and called for a middle ground that balances revenue generation with fair taxation practices.
This approach would ensure that the online gaming industry can thrive without hindering innovation or discouraging investment.
